Barnet (Barney) Kussner

I will miss Barney terribly. I believe that he and I had more cases together (sometimes on the same side but often on opposing sides). I can't think of a single month in the past 30 years that I was not in a case with him. He was the best - a leader in the field. I learned so much from him regardless of whether we were on the same or opposite sides. He loved his family and spoke glowingly, proudly and lovingly about them. I don't know a single person who ever said a bad thing about Barney to me. He left us all far too soon. Ira Kagan

Barney and I met our first week at McGill in 1982. We became instant friends. Barney was 2 years younger than me, so 2 years ahead of his age group - he was simply one of the smartest people I have known. We did everything together for years, throughout McGill and travelled to Israel and Europe together in 1986 for 5 months. I will always treasure his friendship. He could be hilarious, and caring, most of all he was just so so nice. I am heartbroken for his family. I'm so glad I kept in touch over the years. I send my most heartfelt condolences to the Kussners and to everyone whose lives he graced.

Barney and I worked on many files together and it was always a pleasure to have him on the team. His advice was scholarly, strategic and you knew it was advice you and the client could rely on. Barney made a joke when we were in law school 35 years ago that I literally still laugh out loud about, to this day. (More than one, actually, but I'll just share the one.) He was poking fun at the generic judges who happened to be on the panel with Lord Denning - "I agree, but if I am wrong, I dissent". What a fine, funny, and decent man Barney always was. I knew Barney from of the earliest days of his practice and am deeply saddened at the news of his death. Always prepared, always statesmanlike he gave generously of his time to mentor others. Barney represented our condominium corporation when we dealt with the OMB. He was wonderful, kind and very patient. I am heartbroken for the entire Kussner family. Barney and I were very close in our younger days - summer camp, group trip to Israel, and McGill. We stayed in touch and met regularly to catch up with each other's lives. The news of Barney's passing was so devastating that it took me a while to think about what to say. But my thoughts kept coming back to an anecdote that captures Barney's gentle sense of humour to a tee. It is a simple story but it has stuck with me for more than 30-years. Barney told me that he was in New York and happened upon Hal Linden, the actor who played Barney Miller on the popular television series. It took Barney a few minutes to muster the courage to approach him. Finally, he cleared his breath and told Hal Linden "my name is Barney, too". Hal glanced over at him dismissively and said "why are you telling me this, kid?" I am not doing this justice but Barney told this story with perfect timing and self-deprecating wit. Barney was simply exceptional counsel. I say with a smile, filled with admiration, that this caused me no end of grief because we were always on opposite sides. Some of my most difficult cases, hotly contested, filled with passions and politics, involved Barney as counsel opposite. On one occasion I lost my temper and overreacted to a turn of events. The next day I apologized to Barney. I shared with him a personal loss that was affecting me. He accepted my apology without reservation or hesitation and shared a similar personal experience. That is our Bar at its best. Those who don't practice law are often bemused to hear us speak to the Court of our "Friend" opposite. But when it came to Barney, I meant it in every way. I am sure that you are receiving dozens of messages similar to this from those who worked with Barney. I am a lawyer practising in Barrie, Ontario. For many years I practised in a private firm, and now work in-house with the County of Simcoe. I have known Barney for a very large part of my years in practice. I have co-counselled with him, and I have been on opposite sides. Barney was a pleasure to be with, regardless of which side of the room I was on. As a co-counsel, I was always assured we would both be prepared. As opposing counsel, I always knew he would be fair. I also knew that if I needed help on a case in which he wasn't involved, I could ask him for that help. And, as a fellow Jew, and living in a small City, I could call on him for that special kind of guidance as well. While my loss is so much less than that of his family, you can be sure that his friends and his colleagues will be missing him deeply as well.

I am so fond of Barney. We met about 20 years ago when he was my articling principal. And, over the years, I'm always so pleased when our paths cross. Barney is kind, intelligent, with a great (low key) sense of humour. My heartfelt condolences to Barney's family and friends.

I had the privilege of learning so much from Barnet in the two opportunities I had to be working alongside him as part of the Weir Foulds team over the last 25 years. Lisa and family, I am so sorry for your loss. It is shocking and heartbreaking. I had the pleasure and privilege of working closely with Barney on many files during my time at WeirFoulds. Barney was such a kind person. His calm and respectful demeanor was particularly comforting to a junior lawyer, as I was working with him. I learned so much from Barney – about the law, about practicing with civility and integrity, and about not taking things too seriously. He was also very funny; his dry wit often had me laughing out loud. Barney was a heavy-weight in the Municipal Bar. This is a huge loss for us all.

My Thoughts and Prayers to Barney's family, friends and colleagues. He was a wonderful, brilliant generous man who should not be leaving us this soon. I had the pleasure of working with him for 8 years in the early 2000's. Although he did not originate the phrase "belts and suspenders" every time I use it I think of him. I think of him on April 15th and October 15th - his 2 birthdays. I regret not keeping in in touch with him and now I can't. He will be sorely missed.

I am heartbroken to learn this sad news. I only knew Barney as a member of the municipal bar, but felt a strong personal affinity for him. I always loved working with Barney, whether in opposition or (preferably) on the same side. He was always gracious, thorough and a pleasure to be around. Barney had a dry sense of humour that was always well received (even in development charges hearings!). We worked together on a mediation that resulted, in my mind, in one of the best settlement outcomes for the developer/resident/municipal communities. Something else I liked about Barney, strangely enough, is that he also had a temper, deployed at the right time under the right situations which revealed his authenticity and passion. I'm sad because I looked forward to continuing to practice with Barney, learn from him. I wish his family, whom he always mentioned with happiness and excitement, peace in their mourning and grief.

Francy and family - heartfelt condolences for this devastating loss. I have heard many tales about the exploits of the UTS class of 1982 as my brother is part of a group that continues to gather. I’m told that Barney was hilarious and kind and brilliant and loyal. What more could anyone ask?

Barney and I went to UTS together. Perhaps it was in Level I when our whole grade went overnight up to Camp Tawingo. We were not very happy with the food, and some students were overheard making disparaging remarks about it; the kitchen staff were not happy about these comments. So Al Fleming, not the principal at that time, gathered us together to admonish us about our inconsiderate remarks: “These people have been preparing food for hours”, he began, whereupon Barney whispered in my ear, “Did he say PREparing or REpairing?” I laughed, and people looked at me as if I was the one who had done something wrong, which seemed unfair. Barney never stopped being funny, and his humor never put anyone down - his humor made the world a better place. And Barney made the world a better place. I’m sure he was a good lawyer, but more than that, he was a good person. And so I was saddened to hear, in 1982, that he would be doing his undergraduate degree in Montreal, as I was staying in Toronto. But that was nothing like the sadness of hearing of his untimely death, which hit me hard. We met for lunch a couple of years ago, and I was delighted to see him happy. It breaks my heart that I will never see my friend again.

My sincerest condolences to the Kussner family for their loss. I had the great pleasure of observing Barney in action at LPAT. He was, in my view, one of the shining lights of the municipal bar.

We were neighbours many years ago on Brookview. I remember how close the Kussner siblings were; living on the same street and spending time together on the weekends.
